1. Acceptance of Terms

By accessing or using fireflare ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement.

3. Accounts

You are responsible for maintaining the security of your account credentials. You are liable for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User-Generated Content

Ownership. You retain all rights to the content you submit to the Service ("User Content"), including prompts, descriptions, comments, and media. By posting User Content, you grant fireflare a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, distribute, and make available your User Content solely for the purpose of operating and providing the Service.

Forking. When you publish a prompt with public visibility, other users may fork (copy and modify) it in accordance with the Service's functionality. Forked prompts maintain attribution to the original author through lineage tracking.

Responsibility. You are solely responsible for the content you post. You represent that you have all necessary rights to post your content and that your content does not infringe any third-party rights.

5. Prohibited Content and Conduct

You agree not to use the Service to:

• Post content that is unlawful, defamatory, harassing, threatening, or promotes violence
• Post content that infringes intellectual property rights of others
• Post malicious prompts designed to cause harm, extract private data, or circumvent AI safety measures
• Distribute malware, spam, or engage in phishing
• Impersonate another person or misrepresent your affiliation
• Attempt to gain unauthorized access to the Service, other accounts, or connected systems
• Scrape or collect user data without consent
• Use the Service for any illegal purpose

We reserve the right to remove any content and suspend or terminate accounts that violate these prohibitions, at our sole discretion and without prior notice.

6. Content Disclaimer and Limitation of Liability

fireflare is a platform, not a publisher. We do not review, endorse, or assume responsibility for any User Content posted on the Service. The views, opinions, and content expressed by users are their own and do not represent the views of fireflare.

No warranty on content quality or safety. Prompts and other User Content are provided "as is." We make no representations or warranties regarding the accuracy, reliability, effectiveness, or safety of any prompt or content shared on the Service. Using prompts from the Service with AI systems is done at your own risk.

No liability for AI outputs. fireflare is not responsible for any outputs, results, or consequences arising from the use of prompts obtained through the Service with any AI model or system. Users are solely responsible for evaluating the suitability and safety of prompts before use.

Limitation. To the maximum extent permitted by applicable law, fireflare and its operators, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any User Content posted on the Service; (c) any conduct or content of any third party on the Service; or (d) unauthorized access, use, or alteration of your content or transmissions.

7. Copyright and DMCA

We respect the intellectual property rights of others. If you believe content on the Service infringes your copyright, you may submit a takedown request to our designated agent at legal@fireflare.io with the following information:

• Identification of the copyrighted work claimed to be infringed
• Identification of the material that is claimed to be infringing, with sufficient detail to locate it
• Your contact information (name, address, telephone, email)
• A statement that you have a good faith belief the use is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

We will respond to valid takedown requests in accordance with applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless fireflare and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

9. Service Availability

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

10. Termination

We may terminate or suspend your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
